Not Why use 'to be' in phrases like 'not to be confused withwith' instead of 'not to confuse with'?

I know this'not to be confused with' is correct but again dontdon't know why. Why do we say this instead of "Not to confuse with" and " Not"Not to be mistaken for" instead of "Not to mistake for" ?
